Description

GENERAL ITEMS

9. FIFTH RESOLUTION TO ACQUIRE AN ELEMENTARY SCHOOL SITE IN NORTH PORT
Description
On October 5, 2010, the Board approved the First Resolution, authorizing the acquisition of numerous small parcels for a future elementary school in North Port.  This Fifth Resolution approves the fourth batch of contracts for this acquisition.

Recommendation
That the School Board approve the Fifth Resolution of the School Board of Sarasota County, Florida, RE:  Acquisition of Property for a Future Elementary School in North Port, Florida.

AGREEMENTS/CONTRACTS

10. APPROVAL OF THE MEMORANDUM OF UNDERSTANDING BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND THE SCHOOL DISTRICT OF MANATEE COUNTY, FLORIDA
Description

The purpose of this Memorandum of Understanding is to delineate the relationship and responsibilities of the School Board of Sarasota County and the School District of Manatee County, and to outline the conditions, responsibilities of the parties, and the services to be provided by each Board in regard to the Adults with Disabilities Grant Program, State of Florida Specific Appropriation 30, beginning with the 2010-2011 Funding year.

During the term of this Agreement, the School Board of Sarasota County and the School District of Manatee County agree to provide those specific program services as described in the Adults with Disabilities Grant Program and in accordance with the terms set forth and requirements, conditions, and instructions contained in the Grant.  Funding under this Agreement shall be utilized for the purpose of providing reasonably necessary program services as defined by the School Board and School District for the exclusive benefit of the clients described in the Adults with Disabilities Grant Program.



Recommendation
That the Memorandum of Understanding between the School Board of Sarasota County, Florida, and the School District of Manatee County, Florida, be approved.

11. APPROVAL OF THE CONTRACTED SERVICES WITH VISCOM AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA
Description
This contract provides for interpreting services for hearing impaired high school students throughout the district.  This contract in the amount of $50,000 is in excess of the $50,000 limit, which requires School Board approval.

Recommendation
That the contract with Viscom and the School Board of Sarasota County, Florida, for interpreting services for hearing impaired high school students throughout the district be approved.

GRANTS

12. APPROVAL OF THE LAURA BUSH FOUNDATION FOR AMERICA'S LIBRARIES GRANT PROPOSAL TO THE LAURA BUSH FOUNDATION FOR AMERICA'S LIBRARIES FOR BOOKER MIDDLE SCHOOL MEDIA CENTER
Description
COMPETITIVE:  Grant funds of $5,600 will allow the Booker Middle School Media Center to purchase approximately 80 Playaway devices and their accompanying books.  These devices will be used by struggling, reluctant and below level readers to improve their comprehension, fluency, vocabulary and decoding skills.  This activity will contribute to the Booker Middle School improvement plan by contributing to the level of learning gains and reading proficiency among our students.

Recommendation
That the School Board of Sarasota County approve the Laura Bush Foundation for America's Libraries grant proposal.

13. APPROVAL OF SPRING ARTS SHOW, 2011 GRANT PROPOSAL TO THE EDUCATION FOUNDATION FOR THE CURRICULUM & INSTRUCTION DEPARTMENT
Description
COMPETITIVE:  Grant funds of $3665 will allow the Curriculum & Instruction Department to produce the annual county Spring Art Shows for students in visual art classes.  The purpose of the art shows is to exhibit, recognize, and celebrate the achievements of students in visual art classes.

Recommendation
That the School Board of Sarasota County approve the Spring Arts Show 2011 grant proposal.

FIELD TRIPS

14. APPROVAL OF THE PINE VIEW SCHOOL HIGH SCHOOL CHORUS FIELD TRIP TO NEW YORK, NEW YORK ON MARCH 11, 2011 THROUGH MARCH 14, 2011
Description

Students will be given the opportunity to participate in the National Festival Chorus.



Recommendation

That the Pine View High School Chorus trip to New York, New York, on March 11, 2011 through March 14, 2011, be approved.



EXPULSIONS

15. APPROVAL OF EXPULSION CASE NO. 11-009
Description
On September 7, 2010, the student listed in Expulsion Case No. 11-009, violated School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 30, 2012.

Description
The student listed in Expulsion Case No. 11-134, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On October 20, 2010, the student listed in Expulsion Case No. 11-134, violated School Board Policy 5.34(1)(g), Aggressive Threatening Behavior.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 6, 2011.

Description
The student listed in Expulsion Case No. 11-191, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On December 1, 2010, the student listed in Expulsion Case No. 11-191, violated School Board Policy 5.34(1)(d), Physical Battery on Another Student.  It is the recommendation of the Superintendent, that the student be expelled from the Sarasota County Schools until June 15, 2012.

That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 11-191, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2010-2011 academic year, the 2011 summer session, and the entire 2011-2012 academic year.

Description
The student listed in Expulsion Case No. 11-053, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On September 22, 2010, the student listed in Expulsion Case No. 11-053, violated School Board Policy 5.34(1)(g), Disruption to School Function/Insubordination.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 6, 2011.

MATERIALS MANAGEMENT

25. APPROVAL TO AWARD BID #11-0026 FOR RECYCLING SERVICES - SCRAP METALS AND WHITE GOODS
Description
Bids to provide 'Recycling Services - Scrap Metals and White Goods' were received from two vendors on December 9, 2010.  The bid of Trademark Metals Recycling, LLC, was the best bid meeting the advertised specifications.  This bid is for a period of two years with the option to renew for two additional one-year periods. These services will generate revenue for the District.

Recommendation
That the bid of Trademark Metals Recycling, LLC, to provide 'Recycling Services - Scrap Metals and White Goods' be approved for award.

CONSTRUCTION

26. APPROVAL OF CONSTRUCTION MANAGER'S PRECONSTRUCTION SERVICES CONTRACT FOR THE LAUREL NOKOMIS SCHOOL-HVAC RENOVATION PROJECT
Description
The project's scope of work shall include replacement of the complete HVAC system and renovation of all affected spaces.  On 1/4/2011 (Item #31), the School Board authorized negotiations with this company.  On 1/12/2011, the Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) met with a representative from Tandem Construction, to negotiate a contract for this project.  This contract covers the pre-construction portion only for this project.  The contract for construction will be negotiated separately at a later date.  This contract amount is $38,400.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The construction budget is approximately $10,000,000.00.  Funds for this project are available in the capital budget account.

Recommendation

That the construction manager's preconstruction services contract for the Laurel Nokomis School - HVAC Renovation project be approved as presented.



27. APPROVAL OF COMMISSIONING AGENT'S CONTRACT FOR THE BOOKER HIGH SCHOOL-REBUILD PROJECT
Description

The project's scope of work shall include commissioning services for the reconstruction of the Booker High School campus buildings.  On 6/15/201 (Item #48), the School Board authorized negotiations with this company.  On 1/11/2011, the Director of Construction Services and two (2) members of the Professional Services Selection Committee (PSSC) met with a representative of Affiliated Engineers, Inc. and successfully negotiated a contract.  The amount of this contract is $160,000.00.  These documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  Fund for this project are available in the capital budget account.



Recommendation
That the commissioning agent's contract for the Booker High School - Rebuild project be approved as presented.

28. APPROVAL OF CONSTRUCTION MANAGER'S PRECONSTRUCTION SERVICES CONTRACT FOR THE SARASOTA MIDDLE SCHOOL-RENOVATION PROJECT
Description
The project's scope of work shall include replacement of the complete HVAC system and renovation of all affected spaces.  On 1/4/2011 (Item #32), the School Board authorized negotiations with this company.  On 1/11/20111, the Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) met with a representative from Jon F. Swift, Inc. to negotiate a contract for this project.  This contract covers the pre-construction portion only for this project.  The contract for construction will be negotiated separately at a later date.  This contract amount is $38,500.00.  These contract documents have been approved by the School Board attorney and are available for review at the Construction Services Department.  The construction budget is approximately $10,000,000.00.  Fund, in the amount of $2,000,000.00 for this project are available in the capital budget account.

Recommendation
That the construction manager's preconstruction services contract for the Sarasota Middle School-Renovation project be approved as presented.

29. ACCEPTANCE OF CONSTRUCTION SERVICES' PROJECT(S) COMPLETION AND APPROVAL OF FINAL PAYMENT TO CONTRACTOR(S)
Description
The substantial completion dates, original and final contract amounts are summarized on the enclosure for ease of review.  All work has been completed and all required close-out documents have been received from the contractor(s).  The Director of Construction Services has determined that the project(s) are complete in accordance with state statutes.

Recommendation
That the cited Construction Services' project(s) be accepted as complete and the final payment to contractor(s) be approved as presented.

30. APPROVAL OF AMENDED ANNUAL CERTIFICATION OF PROFESSIONALS FOR CONSTRUCTION RELATED SERVICES
Description
The amended list adds two firms that were inadvertently not included on the list approved on 1/4/2011 (Item #29).  The recommended professionals have submitted request for annual certification by the School Board to provide professional construction related services for Sarasota County School Board projects.  These submissions are in accordance with School Board Policy #7.71.

Recommendation
That the amended Annual Certification of Professionals for Construction Related Services be approved as presented.

31. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES' CHANGE ORDER(S)
Description

The Construction Services' Change Order(s) are summarized on the enclosure for ease of review.  These change orders collectively total a decrease of $287,760.99 in gross contract dollars.

Included in these change orders are $352,139.23 credits for Direct Material Purchases; the corresponding Direct Material Purchase Orders of $332,254.00 result a net $19,885.23 in sales tax savings.

FINANCE

32. APPROVAL OF SUPERINTENDENT'S FINANCIAL STATEMENTS FOR THE MONTH ENDING OCTOBER 31, 2010
Description
The Superintendent's Financial Statements for the month ending October 31, 2010, does not reflect any unexpected trends at this early stage in the 2010-11 fiscal year.  The negative trend in the General Fund is to be expected as the District does not receive their main funding source, property tax revenues, until late November.  However, the deficit spending in the General Fund will continue as fund balance has been budgeted to decrease this fiscal year due to State revenue shortfalls and reduced property tax revenues.  The Special Revenue Funds show decreases in revenue from the Federal government and expenditures as the District is receiving less American Recovery and Reinvestment Act (ARRA) money in the current year.  The Food Service Fund shows an increase in revenue of almost 20% year to date.  Both the revenue received from the National School Lunch Program and purchased meals have increased.  Expenditures have increased approximately 33% from the prior year.  This is expected as the number of meals increases.  The Capital Projects Fund reflects monies received from the issuance of the Certificates of Participation, Series 2010A (Qualified School Construction Bonds) and Certificates of Participation, Series 2010B. 

Recommendation
That the Superintendent's Financial Statements for the month ending October 31, 2010, be approved as presented.

33. APPROVAL OF SUPERINTENDENT'S FINANCIAL STATEMENTS FOR THE MONTH ENDING NOVEMBER 30, 2010
Description
The Superintendent's Financial Statements for the month ending November 30, 2010, does not reflect any unexpected trends at this early stage in the 2010-11 fiscal year.  The General Fund has reversed the negative unrestricted fund balance from the prior month with the receipt of property tax revenue.  Deficit spending will continue in the General Fund as fund balance has been budgeted to decrease this fiscal year due to State revenue shortfalls and reduced property tax revenues.  The Food Service Fund shows a decrease in revenue of approximately 36% in Federal revenue year to date.  This is due to the decrease in the funding for the Fresh Fruit and Vegetable Program.  The Self Insurance revenues have decreased approximately 46% from the prior year.  This is due to the change in the percentage charged to other funds for worker's compensation from 1% to 0.1%.  This percentage is anticipated to revert back to its prior level next fiscal year.

Recommendation
That the Superintendent's Financial Statements for the month ending November 30, 2010, be approved as presented.

34. APPROVAL OF THE SIGNATORY PUBLIC AGENCY ADDENDUM FOR THE FLORIDA EDUCATION INVESTMENT TRUST FUND
Description
This addendum to our Investment Advisory Agreements is necessary in order for PFM to invest our idle COPs proceeds with the Florida Education Investment Trust Fund.
